MOA gives more power to city traffic enforcers
ILOILO CITY – A memorandum of agreement (MOA) on traffic rules drafted this week between the Land Transportation Office (LTO) and the city government here seeks to give more recognition to local autonomy and power of the local government unit in implementing traffic rules in its territorial jurisdiction.
City Mayor Jerry P. Treñas said the MOA is expected to put to rest the volatile situation last week between LTO officials and operatives on one hand and the city traffic enforcers, Traffic Management and Engineering Unit (TMEU) and city officials regarding traffic laws implementation.
The MOA may itself be a model one for all local governments in the country to follow in showing local autonomy mandated by Republic Act 7160 or the Local Government Code of 1991, according to Department of Interior and Local Government (DILG) Reg. Dir. Evelyn Trompeta.
In a meeting last Monday, February 16 at the city mayor’s office, representatives of LTO, DILG and the city government arrived at an agreement to allow the respective LGU sanggunians to enact ordinances regulating traffic on all streets according to Section 458 of RA 7160.
The city council is expected to authorize the city mayor to sign the MOA in behalf of the city government.
Under the agreement, the DOTC-LTO authorizes and deputizes all qualified members of TMEU including all traffic aides to regulate and manage public transportation and vigorously order on the streets by relentless law enforcement operations against colorum operators, smoke belchers, seatbelt law violators and other violators of traffic and administrative rules.
The DOTC-LTO will provide technical assistance such as mandatory and technical trainings to traffic enforcers of the city government to improve their capabilities in view of the adoption of new technologies and paramount work methods and strategies.
Under the agreement, the deputized traffic enforcers shall issue the LTO-issued Temporary Operator’s Permit (TOP) upon confiscation of driver’s license and the LTO impounding receipt if there is a need to impound the vehicle.
The TMEU traffic enforcers shall also issue the traffic citation ticket described in City Ordinance No. 338 and other traffic ordinances; impose fines and surcharges in violation of local ordinances.
Signatories to the MOA include DOTC ASec Arturo Lomibao who is the LTO chief, city mayor Jerry P. Treñas, LTO Reg. Dir. Gerard Camiña, TMEU chief SInsp. Robert Foerster and city councilor Erwin Plagata who is the chairman of the traffic technical working group.
